Attorney Charged in Fatal Hit-and-Run Collision Due in Court

Spencer Freeman Smith will return to court for a pretrial hearing

The lawyer from San Ramon, who has been charged with felony hit-and-run in the death of a bicyclist riding on Dougherty Road in Dublin in May of 2012, will be back on court later this month. 

Spencer Freeman Smith is scheduled to be at the Gale-Schenone Hall of Justice in Pleasanton for a pretrial appearance on July 22 at 9 a.m, according to Eamon O'Connor of the Alameda County District Attorney's Office. 

Smith is accused of hitting bicyclist Bo Hu, 57, who was visiting Dublin from China when he was killed in the intersection of Dougherty Road and Fall Creek Road on May 15 around 11:30 p.m. Smith was charged with felony hit-and-run and a misdemeanor count of vehicular manslaughter. 

In a previous Patch article, William Gagen, Smith's lawyer said, "The question is did he [Smith] realize he hit a human being. He realized he hit something because there was a huge hole in the windshield. He called his insurance company the next day and left it parked in the garage."

During that interview, Gagen told Patch Smith did not call Dublin Police to report the collision.

Smith practiced law in San Francisco at the time of the collision.
